    Chanel och/eller dess dotterbolag runt om i världen äger domännamnet "www.chanel.com". Webbplatsen är en skapelse som skyddas av immaterialrätt. Webbplatsen i sin helhet och de produkter som säljs på den samt all tillhörande immateriell egendom (t.ex. texter, kartor, program, databaser, animationer, fotografier, illustrationer, ljud, färgkoder, diagram, logotyper, varumärken och design) är exklusivt ägda av Chanel och/eller dess dotterbolag runt om i världen och/eller har regelbundet licensierats till Chanel. Chanel och/eller dess dotterbolag runt om i världen har ensamrätt att använda de tillhörande immateriella rättigheterna.

    Det är strängt förbjudet att använda hela eller delar av webbplatsen, inklusive nedladdning, reproduktion, överföring, presentation eller distribution, i andra syften än för personligt och privat bruk, kommersiellt eller på annat sätt. Om dessa bestämmelser inte följs kommer de påföljder som föreskrivs i lag att tillämpas.

    När du använder funktionen "Dela" på webbplatsen för att dela en CHANEL-produkt, ett evenemang eller ett meddelande, bekräftar och accepterar du att det innehåll som kan delas endast får användas för rent personliga ändamål, vilket utesluter all kommersiell användning på webbplatser eller webbsidor och/eller andra kommersiella digitala medier.

    För allt innehåll som du skickar in när du använder tjänsten Produktrecensioner som definieras i artikel 5 i Användarvillkoren, ger du Chanel, utan kostnad och för en tid av trettio (30) år, rätten att använda, reproducera, kopiera, ändra, radera hela eller delar av innehållet, anpassa, publicera, översätta, skapa verk som härrör från innehållet, samt rätten att licensiera, underlicensiera, sälja, distribuera och/eller integrera det i vilken form som helst, med hjälp av vilket medium eller vilken teknik som helst över hela världen, utan att du får någon ersättning.

    För att skapa hyperlänkar till webbplatsen krävs Chanels skriftliga förhandsgodkännande som kan återkallas när som helst.

    Alla webbplatser med en hyperlänk till webbplatsen är inte under Chanels kontroll och Chanel avsäger sig därför allt ansvar (särskilt redaktionellt) för tillgång till sådana webbplatser och deras innehåll.

    För smycken som presenteras på Chanel Jewellery-webbplatsen är priserna angivna för en 52 eller medium ringstorlek och kan därför också variera för en mindre eller större storlek.

    5. RECENSIONER AV DOFT- OCH SKÖNHETSPRODUKTER

    Denna artikel reglerar din användning av den tjänst för produktrecensioner som Chanel erbjuder för sektionerna "Parfym", "Smink" och "Hudvård" på webbplatsen (nedan kallade "Produktrecensioner").

    5.1 Syftet med produktrecensionerna

    Produktrecensioner gör det möjligt för webbplatsens kunder att lämna sina åsikter, förslag och rekommendationer enbart om de doft- och skönhetsprodukter som säljs på webbplatsen (nedan kallade "produkter"). Dessa åsikter, förslag eller rekommendationer ska åtföljas av ett betyg från 1 till 5 stjärnor, där 5 stjärnor är det bästa betyget som kan tilldelas en produkt (nedan kallade "recension(er)").

    För att kunna lämna en recension av en av produkterna måste kunden ha köpt produkten i fråga på webbplatsen under det senaste året.

    Om en kund har köpt produkten med ett gästkonto bör hon först skapa ett kundkonto för att kunna lämna sin recension.

    En recension måste innehålla minst 10 tecken.

    Det innehåll som du skickar som en del av produktrecensionerna används av Chanel för att analysera hur nöjda våra kunder är.

    5.2 Innehållet i produktrecensioner / Användarnas ansvar

    Genom att skicka innehållet garanterar du:

    • att du är ensam upphovsman och/eller ägare till alla rättigheter som rör det nämnda innehållet eller att du har en licens för rättigheterna som ger dig rätt att skicka det nämnda innehållet till Chanel;
    • att du frivilligt har avstått från alla "moraliska rättigheter" som du skulle kunna ha till det nämnda innehållet;
    • att allt innehåll som du skickar är korrekt;
    • att du är minst 18 år gammal eller att du har fått förhandstillstånd från en förälder eller juridisk representant att lämna innehåll, Chanel ska kunna be varje minderårig användare att tillhandahålla bevis för detta tillstånd och, vid behov, vägra att publicera en recension från en minderårig användare som inte kan tillhandahålla bevis för detta tillstånd;
    • att Chanels användning av det innehåll som du tillhandahåller inte bryter mot användarvillkoren och inte skadar någon person eller enhet.
     

    Dessutom samtycker du till att inte skicka något innehåll:

    • som du vet är falskt, felaktigt eller vilseledande;
    • som bryter mot eller inkräktar på någon upphovsrätt, patenträtt, varumärke, affärshemlighet och/eller andra immateriella rättigheter, äganderätt, publicitetsrättigheter för någon tredje part och/eller sekretessavtal;
    • som bryter mot någon lag eller regel, eller mot något dekret eller någon förordning (inklusive, men inte begränsat till, de som reglerar konsumentskydd, illojal konkurrens, diskriminering eller falsk reklam) och mer allmänt mot något regelverk;
    • som rimligen kan anses vara ärekränkande, nedsättande, uppmuntrande till hat, partisk, stötande eller förolämpande, särskilt med avseende på ras eller religion, som hotar på ett olagligt sätt eller som utgör olagliga trakasserier mot någon individ, person, avtal, partnerskap eller företag;
    • för vilket du har fått betalt eller fått ersättning av en tredje part som inte är godkänd av Chanel;
    • som omfattar information som hänvisar till andra webbplatser än webbplatsen, reklam, varumärken från tredje part eller innehåll som inte är relevant för de produkter som säljs på webbplatsen, fysiska adresser, e-postadresser, kontaktuppgifter eller telefonnummer eller annan information som gör det möjligt att identifiera en person;
    • som innehåller kommentarer om produkternas medicinska eller farmaceutiska prestanda;

    5.3 Offentliggörande av recensioner

    Innehållet i recensionerna får inte strida mot användarvillkoren och får inte skada Chanels image eller handelspolicy.

    Chanel förbinder sig att inte ändra kundernas omdömen innan de publiceras, med undantag för stavning av produktnamnen om de är felaktiga. Varje recension granskas dock manuellt av Chanels kundtjänst innan den publiceras, för att kontrollera att den uppfyller kriterierna för publicering, särskilt de som anges i artikel 5 i användarvillkoren. Recensionerna kommer att publiceras oavsett betyg, förutsatt att de uppfyller kriterierna för publicering och användarvillkoren.

    Du inser att du, och inte Chanel, är ensam ansvarig för innehållet i ditt bidrag. Ingen del av det innehåll som du skickar ska omfattas av Chanel (inklusive dess chefer, direktörer, agenter, aktieägare, dotterbolag, gemensamma företag, anställda, partner eller tredjeparts-leverantörer, samt deras respektive direktörer, representanter och anställda).

    Chanel förbinder sig att inte betala någon användare för att få dem att lämna en eventuell recension.

    Recensionerna ska offentliggöras i genomsnitt mellan 48 och 72 timmar efter det att de har lämnats in. Processen kan ta längre tid om recensionen måste granskas i detalj av Chanels specialiserade team.

    Recensionerna laddas upp på webbplatsen i kronologisk ordning.

    När en recension har publicerats på webbplatsen har användarna möjlighet att via en länk berätta om de har funnit den användbar eller inte.

    6. ÄNDRINGAR

    Chanel informerar dig om att dessa användarvillkor kan ändras när som helst. Sådana ändringar publiceras online och anses accepteras villkorslöst när du går in på webbplatsen efter att de har publicerats online. Chanel rekommenderar att du kontrollerar denna sida regelbundet.

    7. SEVERABILITET

    Om någon klausul i dessa användarvillkor befinns vara ogiltig på grund av en ändring i lagstiftning eller bestämmelser eller ett domstolsbeslut kan detta inte på något sätt påverka giltigheten och efterlevnaden av övriga klausuler i användarvillkoren.

    8. TILLÄMPLIG LAG OCH TVISTER

    Dessa användarvillkor regleras av fransk lag utan att du för den skull behöver ta del av det skydd som ges av bestämmelserna i den tvingande lagstiftningen i det land där du har din vanliga hemvist.

    Om ingen uppgörelse i godo kan nås har de franska domstolarna i Paris territoriell behörighet att behandla alla tvister som rör webbplatsen, även om du har möjlighet att föra tvisten till en behörig utländsk domstol som du väljer.

This privacy policy applies for the collection and further processing of your personal data in connection with our interaction with you when (i) you visit one of our boutiques, (ii) you purchase our products or benefit of services in one of our boutiques or (iii) when you fill in and submit one of our Boutique Cards.

We collect certain personal information about you, either through our Boutique Card or throughout our customer relationship or generally when we interact with you in connection with one of our boutiques. Therefore, we may collect the following personal data about you:

  • Purchase Data:
    Date of transaction, customer ID, return (yes/no), transaction ID, boutique ID, channel, sales associate ID, total quantity, shipping amount, total amount local currency, total amount global currency, product ID, quantity, price, discount, sample (yes/no), taxes, net sales amount, net sales amount global currency, number of purchased products per type, segment allocation (incl. country, boutique, etc.);
  • After Sales Data
    Customer ID, current location, next location, creation date, last update, ticket ID, status, assignee ID, contact channel, reason, division, order no., number of previous requests, creation date, closed date, case ID, priority, case type, contact name, quantity, after-sales price, subject, description, proof of purchase (yes/no), date of purchase, boutique of purchase, product ID, communicated end, estimated end, comments for workshop, final action taken, segment allocation (incl. country, boutique, etc.);
  • Marketing Data:
    consent, wish to receive communications, wish to share / merge data or not, channel mail, channel postal, channel SMS, area of preference (Fashion, Watches & Jewelry, Fragrance & Beauty), boutique of preference, sales advisor of preference; event related data;
  • Identification Data:
    Type of identification document (e.g., passport, national ID Card), document number, expiration date, delivery date
  • Interests Data:
    Languages spoken, favorite CHANEL products, interests, reactions to marketing campaigns;
  • Social Data:
    Profession, public profiles on social networks, follow-up by an advisor/personal stylist;
  • Request Data:
    Type of relationship with CHANEL (e.g., customer, employee or other), last name, first name, type of request (e.g., personal information rectification or deletion request), further request details necessary to process your request (e.g. identification details), and the content of your request provided to us.

2. Processing purposes

If you are an existing or prospective customer of or otherwise interact with CHANEL, we may use your personal data for the following purposes (“Processing Purposes”):
  • Purchase-related Purposes:
    Manage your purchases, payments and deliveries, your appointments, orders and reservations, and in particular, if applicable, your registration on a waiting list;
  • Service-related Purposes:
    Allow you to benefit from our warranties and after-sales- and other services offered in our boutiques, for instance, to book an appointment;

4. Transfer of your personal data

Within the CHANEL Organization. To the extent permitted by law and taking into account the protection of your rights and freedoms in respect of the processing of your data, your data will only be accessible to a limited and defined number of recipients within the global CHANEL entities (“CHANEL Organization”) as further described below. Such data access will strictly take place on a “need to know” basis in order for the recipients to fulfill the Processing Purposes in their capacity as data controllers. We may transfer your data to another legal entity for the purposes of a collaboration, joint venture, corporate reorganization, change of legal form or other similar event. In case of a merger or sale, your data will be permanently transferred to the successor company. You can find a list of the relevant CHANEL entities here.
If you are an existing or prospective client of CHANEL or otherwise interact with CHANEL, only the CHANEL employees within the CHANEL Organization that are working within the teams that need to have your information (for example, Customer Relationship Management, Commercial Management, Legal, Compliance and IT) will access your data.
Third Parties outside of the CHANEL Organization. We may in limited cases transfer your data to governmental agencies and regulators (e.g. tax authorities), courts, and government authorities, all in accordance with applicable law and to external advisors (e.g., lawyers, accountants, auditors etc.), all acting as controllers. In this context CHANEL may also have to transfer your data to third parties when it receives a request by an authority empowered by law to do so, pursuant to applicable laws and regulations.
Service providers (within and outside CHANEL): Your data will generally not be disclosed to recipients outside the CHANEL Organization. In some cases, however, CHANEL makes use of external service providers acting on behalf of CHANEL on the basis of contractual arrangements which will include strict data protection obligations. We will in particular provide your data to service providers or suppliers (this may include other CHANEL group companies) as part of our normal business operations to carry out certain IT-related tasks, conducting our business, servicing you or protecting the security and integrity of our business (including IT maintenance, security and support service provider, hosting provider, payment provider, marketing and advertising partners, mailing or emailing services or customer care center).
5. Retention of your personal data

Your data generally: Alongside the commitment to offering the highest standards of services and products, we consider that our products should entitle you to personalized client treatment and incomparable after-sales services that may last for a lifetime for some products. For this purpose, and to ensure such services, we may need to keep your data for as long as it is needed for the provision of such services. Your Purchase Data will be retained until your last use or purchase of our services or goods as required or permitted by applicable local law or where we have a legitimate and lawful purpose to do so and in any case.
For any product sold, we may keep your data for as long as it is necessary to comply with applicable legislation regarding product guarantee and safety and in order to follow up with you on the results of the product and offer you continuous advice. Your further data will be retained as long as required by applicable local law or to the extent we have a legitimate and lawful purpose to do so. Please note that the storage period provided by legislation may vary per country.
6. Your rights

You may have the following rights to the extent and as provided by the law applicable to you:
  • A right of access and information: you have the right to be informed in a concise, transparent, intelligible and easily accessible form of the way in which your personal data is processed. You also have the right to obtain (i) confirmation as to whether or not personal data concerning you are being processed, and, where that is the case (ii) to access such personal data and obtain a copy thereof.
  • A right to rectification: you have the right to obtain the rectification of your personal data. You also have the right to have incomplete personal data completed.
  • A right to erasure: in some cases, you have the right to obtain the erasure of your personal data. However, this is not an absolute right and CHANEL may have legal or legitimate grounds for keeping such personal data.
  • A right to restriction of processing: in some cases, you have the right to obtain restriction of the processing of your personal data.
  • A right to data portability: you have the right to receive your personal data which you have provided to CHANEL, in a structured, commonly used and machine-readable format, and you have the right to transmit those data to another controller without hindrance from CHANEL. This right only applies when the processing of your Personal Data is based on your consent or on a contract and such processing is carried out by automated means.
  • A right to object to processing: you have the right to object to processing of your personal data when such processing is based on the legitimate interest of CHANEL.     Languages spoken, favorite CHANEL products, interests, reactions to marketing campaigns;
  • Social Data:

4. Transfer of your personal data

Within the CHANEL Organization. To the extent permitted by law and taking into account the protection of your rights and freedoms in respect of the processing of your data, your data will only be accessible to a limited and defined number of recipients within the global CHANEL entities (“CHANEL Organization”) as further described below. Such data access will strictly take place on a “need to know” basis in order for the recipients to fulfill the Processing Purposes in their capacity as data controllers. We may transfer your data to another legal entity for the purposes of a collaboration, joint venture, corporate reorganization, change of legal form or other similar event. If you are an existing or prospective client of CHANEL or otherwise interact with CHANEL, only the CHANEL employees within the CHANEL Organization that are working within the teams that need to have your information (for example, Customer Relationship Management, Commercial Management, Legal, Compliance and IT) will access your data.
